| Abstract: | Diplomová práce je rozdělena do sedmi kapitol. První kapitola je úvodem do problematiky. Druhá kapitola pojednává o vzniku ústavního soudnictví a dále se věnuje krátké komparaci ústavních soudů Maďarska, Polska a Slovinska. V následující kapitole je přiblížen český Ústavní soud, jeho vývoj, významné osobnosti, které zde působily a právní úprava. Po těchto kapitolách následují dvě stěžejní kapitoly, kde dochází k rozboru významných judikátů z obou dekád a jejich zhodnocení. Součástí těchto dvou kapitol jsou medailónky soudců zpravodajů vybraných nálezů. Šestá kapitola se věnuje kritice, která byla adresována Ústavnímu soudu, pokouší se nabídnout řešení některých nedostatků a zabývá se perspektivou Ústavního soudu do jeho "třetí dekády". Následuje závěr, kde dochází ke zhodnocení problematiky. |
| Abstract in different language: | The thesis is divided into seven chapters. First of those is an introduction. Second chapter deals with the origins of constitutional justice and comparison of constitutional courts of Hungary, Slovenia and Poland. In the next chapter the Constitutional court of Czech Republic is analyzed,its origins and development, some of the judges, who were a part of the development of Constitutional court through its history and at the end of this chapter the legal regulations are mentioned. After these, two crucial chapters follow where the jurisprudence of first and second decade of Constitutional court of Czech republic are analyzed. Another component of these chapters are biogpraphies of judges-rapporteurs of the chosen cases. Last part of the thesis deals with criticizm of this institution and its possible future. |
