| dc.description.abstract | Článek nejprve představuje tři základní teoretické koncepce odpůrčího nároku. Dále argumentuje proti pojmu "relativní neúčinnost právního jednání", který vychází z nejstarší z nich a v českém právním myšlení je dosud zakořeněný. Uvádí také praktické souvislosti teoretického sporu. Nakonec se zamýšlí nad tím, zda by nebylo možné odporovat právnímu jednání i námitkou, přestože text zákona nasvědčuje tomu, že odporovat lze jen žalobou. | cs |
