| Abstrakt: | Tato diplomová práce je zaměřena na teoretickou a praktickou analýzu zákonné úpravy spolku a jeho jednotlivých orgánů. První kapitola je věnována právnímu vývoji spolku, po které následuje kapitola o spolkové autonomii, která je u spolků vnímána různými autory rozdílně. Kapitola třetí je zaměřena na založení spolku a jeho pojmové znaky, náležitosti svolání a vedení ustavující schůze. Následující kapitoly teoretické části jsou věnovány orgánům spolku. Rozboru kolektivního a individuálního statutárního orgánu je věnována šestá kapitola. Nejvyšší orgán spolku je tématem sedmé kapitoly. Tato diplomová práce obsahuje mj. srovnání tuzemské úpravy orgánů spolku s úpravou zahraniční, konkrétně úpravu německou a rakouskou. Komparace poukazuje mimo zákonné úpravy na zajímavé odlišnosti ve spolkovém právu. Poslední dvě kapitoly v teoretické části práce se zabývají fakultativními orgány spolku, tj. kontrolní a rozhodčí komisí. Výzkumná část práce je rozdělena do několika podkapitol, ve kterých jsou zjišťovány názvy statutárních a nejvyšších orgánů jednotlivých spolků, jež byly předem vyspecifikovány. Další dvě podkapitoly jsou věnovány spolků s kontrolní a rozhodčí komisí. U všech spolků s kontrolní komisí je podrobně rozebrána úprava komise ve stanovách. Rozhodčí komisi má dle stanov zřízenu pouze jeden zapsaný spolek. Všechna zjištění výzkumné části jsou zhodnocena v závěru této diplomové práce. |
| Abstrakt v dalším jazyce: | This diploma thesis focuses on the theoretical and practical analysis of the legal regulation of registered associations and their various organisational bodies. The first chapter is devoted to the legal development of registered associations and is followed by a chapter on their autonomy, which is perceived differently by different authors. The third chapter focuses on the establishment of registered associations and the conceptual features thereof as well as the requirements set for convening and conducting the establishment meeting. The following chapters that make up the theoretical part are devoted to the various bodies of registered associations. The sixth chapter is devoted to the analysis of collective and individual statutory bodies and the seventh chapter addresses the topic of the supreme bodies of registered associations. This diploma thesis contains, inter alia, a comparison of the domestic (Czech) regulation of registered association bodies with foreign, i.e. German and Austrian regulation. The comparison points out a number of interesting differences in terms of legislation on registered associations, apart from the legal regulation thereof. The final two chapters in the theoretical part deal with the facultative bodies of registered associations, i.e. control and arbitration commissions. The research part of the thesis is divided into several subchapters in which the names of the statutory and supreme bodies of previously specified individual registered associations are determined. A further two subchapters are devoted to registered associations with control and arbitration commissions. The rules governing such commissions are analysed in detail for all registered associations with control commissions. Only one registered association was found to have an arbitration commission according to its statutes of establishment. The conclusion to the thesis consists of an evaluation of the findings of the research part. |
