dc.description.abstractRigorózní práce se zabývá děděním ze závěti a jednotlivými zákonnými aspekty dědického práva. Srovnává dříve platný občanský zákoník s novou legislativou. Problematika je podpořena judikaturou. Jsou popsány formy závěti, způsobilost zůstavitele pořídit závěť a náležitosti potřebné při projevu vůle zůstavitele. Základní zásadou nového občanského zákoníku je totiž snaha o co největší respektování vůle zůstavitele a tato myšlenka je prostoupena celou prací.cs

dc.description.abstract-translatedThis rigorous thesis deals with the issue of inheritance when there is a will, and individual legal aspects of inheritance law. It compares former Civil Code with the new legislation. The issue is supported by the case law. The different types of the will, the ability of the testator to make the will and the requisites necessary for the expression of the testator's will, are described in this thesis. The basic principle of the new Civil Code is to respect the will of the testator as much as possible, and this idea is permeated throughout this thesis.en
