| Abstract: | V tradici rakouského práva je oblast odpovědnosti za vady (z legislativního hlediska) velmi statická, za dvě století platnosti ABGB byla výrazněji novelizována pouze dvakrát. Recentní, implementací evropské směrnice o něk terých aspektech smluv o prodeji zboží vynucená změna, zahrnující kromě změn v ABGB také přijetí zcela nového zákona o odpovědnosti za vady pro spotřebitele, je tak o to významnější. Příspěvek tuto změnu zevrubně představuje, a to včetně významných koncepčních posunů (v čele s posunem od „vad“ k „souladu se smlouvou“, nebo od soudního k mimosoudnímu uplatnění nároků z vadného plnění), které do rakouského práva zavádí. |
| Abstract in different language: | In the tradition of Austrian law, the area of liability for defects is (from a legislative point of view) very static, having been substantially amended only twice in the two centuries the ABGB has been in force. This makes all the more significant the recent change, due mainly to the need for implementation of the European Directive on Certain Aspects of Contracts for the Sale of Goods, which includes, in addition to the changes to the ABGB, the adoption of a completely new Act on Liability for Defects for Consumers. This paper presents this change in detail, including the significant conceptual shifts (including above all the shift from „defects“ to „compliance with contract“ or from judi cial to extra-judicial enforcement of claims arising from defective performance) that it introduces into Austrian law.s |
