Abstract: | Z hlediska systematiky je tato práce rozčleněna do deseti stěžejních kapitol, avšak obrazně rozdělit můžeme tuto diplomovou práci na dvě poloviny. V první z těchto kapitol se můžeme dozvědět vysvětlení samotného pojmu korupce V následující kapitole si přiblížíme historii korupce od samého počátku letopočtu přes historické příklady až do jednadvacátého století. Ve třetí je psychologické a sociologické vnímání korupce. Dělení na formy ve čtvrté kapitole proti sobě staví tři hlavní protikladné formy korupce. V úvodu páté kapitoly se nachází členění na druhy v obecném měřítku, v druhé polovině této kapitoly se dozvíme typy korupčního jednání. Ve druhé polovině této diplomové práce se dostáváme k právní úpravě úplatkářství, podplácení, zneužití pravomoci a dalších jednání, které zahrnuje pojem korupce. Šestá kapitola nás uvede do mezinárodního způsobu boje proti takovému chování. Sedmá kapitola je pro tuto práci nejstěžejnější, jelikož rozebírá hmotněprávní úpravu korupce v České republice. Jsou zde také uvedeny konkrétní příklady jednání. Devátá kapitola je pouze uvedením do problematiky orgánů činných v trestním řízení, operativně pátracích prostředků a zajišťovacích úkonů. Desátá kapitola pojednává o hmotněprávní úpravě korupce ve Slovenské republice.Na konci je srovnání české a slovenské hmotněprávní úpravy zabývající se korupcí. |
Abstract in different language: | This dissertation is divided into ten main chapters due to their systematic but according to another point of view it can be split between two halves. In the following chapter, the overworld history of corruption is introduced, starting with the early era A.D. untill the twenty-first century, illustrated with some historical examples. In the third chapter is psychological and socialogical perceiving of corruption. The division according to forms, in the fourth chapter, contrasts three main contrary forms of corruption. In the introduction of the fifth chapter, classification of general types of corruption is set, in the second part of the chapter specific kinds of corruption behaviour can be found. In the second half of this dissertation legal regulations of bribery are introduced, so all forms of bribing, abuse of power and other acts that are considered to make part of corruption. The sixth chapter contains examples of international pursuits and control of corruption. The seventh chapter is primordial for this work, setting substantive law regulations of corruption in the Czech Republic. There is also some concrete examples of corruption. The ninth chapter introduces into the problematic of bodies active in criminal proceedings, stage of investigation and preparatory proceedings. Tenth chapter deals with substantive law regulations of corruption in Slovak Republic At last is a comparison between Czech and Slovak substantive law regulation of corruption is dealed. |
