| Abstract: | Článek se komplexně zabývá problematikou zjišťování názoru a přání dítěte v soudním řízení. Autor se v článku zabývá zejména analýzou judikatury Ústavního soudu, která se tomuto tématu v poslední době často věnuje. Ústavní soud ve své rozhodovací praxi vymezil řadu podmínek a okolností, které obecné soudy musí ohledně výslechu dítěte dodržet a zvažovat. |
| Abstract in different language: | The article deals with the problem of finding the child's opinion and wishes in court proceedings. In particular, the author deals with an analysis of the Constitutional Court's judgement, which has frequently been devoted to this topic. In its decision-making practice, the Constitutional Court defined a number of conditions and circumstances that general courts must observe and consider regarding the questioning of the child. |
