| Abstract: | Rigorózní práce je zaměřena na správní trestání řidičů motorových vozidel v souvislosti s jejich provozem na pozemních komunikacích v České republice. Práce je členěna do 3 částí. První část pojednává o pramenech práva a základních zásadách správního trestání. Druhá část vymezuje dopravní přestupky, metody jejich třídění a rozbor práva EU - směrnice 2015/413 v souvislosti s přeshraničním postihem dopravních přestupků. Třetí část je zaměřená na vlastní kategorizaci dopravních přestupků a výklad jednotlivých skutkových podstat přestupků, katalog správních trestů, pokut a přehled bodového hodnocení řidiče. Závěrem autor polemizuje o trendech a způsobech postihů za dopravní přestupky a jejich efektivitě. |
| Abstract in different language: | The thesis is focused on the issue of administrative punishment of motor vehicle drivers in connection with their operation in the Czech Republic. The first part deals with the sources of law and the basic principles of administrative punishment. The second part defines traffic offenses, methods of their classification and analysis of EU law - Directive 2015/413 in the context of cross-border prosecution of traffic offenses. The third part focuses on the actual categorization of traffic offenses and the interpretation of the specific nature of individual offenses, a list of administrative penalties, fines and the driver's point assessment system. In conclusion, the author discusses the trends and methods of punishment for traffic offenses and their effectiveness. |
