Abstract: | Tato diplomová práce se zabývá tématikou státního zástupce a jeho působnosti v přípravném řízení ve České republice a Spolkové republice Německo. Autorka se především snaží nalézt odpověď na otázku, zda a do jaké míry je státní zástupce pánem přípravného řízení. Porovnává českou a německou úpravu v této oblasti. Práce je členěna celkem do čtyř kapitol. První kapitola obsahuje krátký historický exkurz, v němž je představeno státní zastupitelství z hlediska jeho vývoje a vlivů, které se podílely na jeho formování. V druhé kapitole jsou zmíněny prameny práva, z nichž působnost státního zástupce vychází, i s jejich hodnocením odborné veřejnosti. Třetí kapitola se týká vzniku dnešního typu trestního procesu, jeho charakteristice, specifikům i zásadám. Čtvrtá stěžejní kapitola je analýzou činnosti státního zástupce doplněnou o jeho vztah jak k policii, tak k soudu působícímu v této fázi trestního řízení. Jsou zde porovnávány obě úpravy z shod a rozdílů. Dále jsou doplněny o názory odborné veřejnosti na dané otázky a názorem autorky. |
Abstract in different language: | This diploma thesis investigates with the topic of the public prosecutor and his competence in the pre-trial proceedings in the Czech Republic and Federal Republic of Germany. The author primarily aims to find an answer to the question of whether and to what extent the public prosecutor is the master of the pre-trial proceedings. The author compares the Czech and German legal regulations in this domain. The work is divided into four separate chapters. The first chapter contains a short historical excursion, in which the public prosecution is introduced in terms of its development and the influences that contributed to its formation. The second chapter mentions the sources of law on which the competence of the public prosecutor are based. The third chapter deals with the formation of today's type of criminal proceedings, its characteristics, specifics and principles. The fourth key chapter is an analysis of the activities of the public prosecutor, supplemented by his relationship to both the police and the court operating in this phase of criminal proceedings. Both adjustments are compared here in terms of similarities and differences. They are also supplemented by the opinions of professionals on the issues and also the opinion of the author. |
