Abstract: | Článek se zabývá problematikou možnosti vyloučení odpovědnosti indosanta vůči indosatáři v případě, kdy indosatář nedosáhne uspokojení směnečné pohledávky po směnečném dlužníkovi. Zejména je uvedená situace řešena s ohledem na judikaturu obsahující výklad připouštějící možnost exonerační doložky mimo samotnou směnku. The article deals with the issue of the possibility of excluding the liability of the transferor towards the acquirer in the event that the acquirer does not achieve the satisfaction of the bill of exchange receivable from the bill of exchange debtor. In particular, with regard to the case-law containing an interpretation which allows the possibility of an exoneration clause outside the bill of exchange itself. |
