| Abstract: | Příspěvek má ambici přispět k veřejné diskusi nad problematickými pracovně-právními vztahy v akademické sféře. Primárním východiskem problému je totiž střet dvou relevantních právních předpisů, a to zákoníku práce a zákona o vysokých školách. Střet těchto předpisů je nutné hledat především ve vlastní povaze každého z nich. Zatímco zákoník práce tradičně zařazujeme mezi právní předpisy soukromého práva, zákon o vysokých školách je již zcela jednoznačně předpisem práva veřejného. Přesto zasahuje do pracovněprávní oblasti a vytváří tak složité vztahy. |
| Abstract in different language: | The paper has the ambition to contribute to the public debate on problematic labor law relations in the academic sphere. The primary source of the problem is the conflict between two relevant legal regulations, namely the Labor Code and the Higher Education Act. The conflict between these regulations must be found primarily in the nature of each of them. While the Labor Code is traditionally included among the legal regulations of private law, the Higher Education Act is already clearly a regulation of public law. Nevertheless, it intervenes in the field of labor law and thus creates difficult relationships. |
