Abstract: | Novela v § 196 tr. řádu zavedla institut vyjádření obžalovaného k podané obžalobě státního zástupce. V návaznosti na skutečnosti popisované v tomto článku je třeba dospět k závěru, že advokát by si měl po vyrozumění státního zástupce o podání obžaloby zásadně opatřit podanou obžalobu a v návaznosti na její obsah zvážit, zda pro obhajobu je účelné vyjádřit se písemně k podané obžalobě. Vyjádření obhájce k podané obžalobě se dotýká samé podstaty trestní věci a za situace, že obhájce učiní vyjádření k podané obžalobě, jedná se o plně účtovatelný úkon právní služby podle § 11 odst. 1 písm. d) AT za použití § 11 odst. 3 AT. |
Abstract in different language: | The article points out the new provisions comprised in Section 177 (d) of the Code of Criminal Procedure, which extended the formal requirements on the contents of a criminal indictment, and in Section 196 (2) of the Code of Criminal Procedure, where the law newly requires the presiding judge to advise the defendant, when serving a copy of the indictment on the defendant, that they have the right to provide, by the set deadline, a statement on the facts set out in the indictment. The author infers that, after having been notified of the indictment by the public prosecutor, the defence counsel should generally ask for a copy of the indictment and, in view of its contents, consider whether it would be purposeful for the defence to provide a written response. It became disputable in judicial practice whether such a response to an indictment drafted by the defence counsel can be considered a chargeable legal service based on the Lawyer’s Tariff. In its decision of 20 October 2021, the Superior Court in Prague concluded that such a response was indeed a fully chargeable act of legal service pursuant to Section 11 (1 (d) of the Lawyer’s Tariff, in conjunction with Section 11 (3) of the Lawyer’s Tariff. |
