| Abstract: | Liniové stavby jsou prospěšné pro celou společnost - přivádějí elektřinu, vodu, plyn, internet a různé zboží (a také lidi) do našich domácností, přes hranice měst nebo států. Bez dostatečné sítě liniových staveb by mohl potenciálně hrozit kolaps moderního způsobu života. Dá se říci, že o významu liniových staveb nemůže být pochyb, nicméně regulace liniových staveb nemusí být tak jednoznačná, zejména pokud jde nejen o umisťování liniových staveb, ale i později, když se vlastníci nemovitostí rozhodnou prodat nebo darovat nemovitosti, na nichž se liniové stavby nacházejí. Právě zvláštní povaha liniových staveb vyvolává otázky, jak by bylo možné takové nemovitosti zcizit. Také při umisťování liniových staveb proti sobě stojí dva instituty, a to právo vlastníka nemovitosti na nerušený výkon jeho vlastnického práva, na druhé straně veřejný zájem na výstavbě liniových staveb. Cílem tohoto článku je odpovědět na některé otázky či problémy související s liniovými stavbami a koupí či darováním nemovitostí, na nichž jsou liniové stavby umisťovány. |
| Abstract in different language: | Line structures are beneficial for society as a whole – they bring electricity, water, gas, the internet and various goods (and also people) into our households, across city limits or country borders. Without a sufficient network of line structures the collapse of the modern way of life could be potentially imminent. It is safe to say that there can be no doubt about the importance of line structures, however the regulation of line structures may not be so clear especially when it comes to not only placing line structures but also later on when property owners decide to sell or donate real estate where line structures are situated. It is the special nature of line structures that raises the questions as to how such real estate could be alienated. Also when placing line structures two institutes oppose each other, namely the right of the property owner to be undisturbed in the exercise of their property right, on the other hand the public interest in the construction of line structures. The aim of this article is to address some of the questions or issues related to line structures and purchase or donation of real estate where line structures are placed. |
