| Abstract: | Článek se zaměřuje na problematiku postihování majetku spadajícího do společného jmění manželů a výlučného majetku manžela povinného při provádění exekuce přikázáním pohledávky z účtu manžela povinného. Na začátku je nastíněna obecná úprava manželského majetkového práva dle občanského zákoníku. Poté se autor zabývá již konkrétně postihováním majetku spadajícího do společného jmění manželů a výlučného majetku manžela povinného při provádění exekuce přikázáním pohledávky z účtu manžela povinného, přičemž je rovněž vysvětleno postavení manžela povinného v exekučním řízení. |
| Abstract in different language: | The article focuses on the issue of penalizing property belonging to the joint property of the spouses and the exclusive property of the obligor's spouse during execution by ordering a claim from the obligor's spouse's account. At the beginning, the general regulation of matrimonial property law according to the Civil Code is outlined. After that, the author deals specifically with the enforcement of property belonging to the joint property of the spouses and the exclusive property of the obligor's spouse during execution by commanding a claim from the obligor's spouse's account, while the position of the obligor's spouse in the enforcement proceedings is also explained. |
