Abstract:	Článek je reakcí na zásadní nedostatečnost a zoufalou kvalitu kritiky návrhu věcného záměru civilního řádu soudního, tematicky se přitom zabývá sporností sporných řízení a jejich definicí (pojmovým vymezením řízení sporného), nesporností nesporných řízení a jejich definicí (respektive nemožností jejich definice) a rozlišením mezi spornými a nespornými právními věcmi jako základem pro určení, v jakém režimu má být ta která věc projednána a rozhodnuta.
Abstract in different language:	The article is a response to the fundamental inadequacy and desperate quality of the criticism of the draft substantive plan of the Civil Procedure Code, while thematically dealing with the contentiousness of contentious proceedings and their definition (conceptual definition of contentious proceedings), the non-contentiousness of non-contentious proceedings and their definition (or more precisely the impossibility of their definition), and the distinction between contentious and non-contentious legal matters as a basis for determining in which regime a particular case should be heard and decided.
