| Abstract: | Tato vědecká studie se zabývá problematikou jednotlivých způsobů nuceného zániku členství v družstvu. Studie je psána podle právní úpravy obsažené v zákoně č. 90/2012 Sb., o obchodních společnostech a družstvech (zákon o obchodních korporacích), ve znění novel provedených zákony č. 33/2020 Sb. a č. 163/2020 Sb., jež nabyly účinnosti 1. 7. 2020 a 1. 1. 2021. Konkrétně se rozebírají jednotlivé způsoby nuceného zániku členství v družstvu, kterými jsou konkurs, oddlužení, exekuce a vyloučení člena. |
| Abstract in different language: | This scientific study deals with the issue of individual methods of forced termination of membership in a cooperative. The study is written according to the legislation contained in Act No. 90/2012 Sb., on business companies and cooperatives (Act on business corporations), as amended by Act No. 33/2020 Sb. and No. 163/2020 Sb., which entered into force on 1. 7. 2020 and 1. 1. 2021. Specifically, the individual methods of forced termination of membership in a cooperative are analysed, which are bankruptcy, discharge of debt, execution, and expulsion of a member. |
