Abstract: | Institut změny pohlaví není navzdory aktuálnosti této problematiky v české judikatuře častým tématem. Jedním z důvodů může být i fakt, že na rozdíl od homosexuality je českému právnímu řádu tento institut znám teprve od 90. let minulého století. Ovšem i tak byly co do otázek týkající se změny pohlaví českými soudy řešeny velmi zajímavé případy. Tím nejvýznamnějším je případ paní T. H. Ta se navzdory současné právní úpravě institutu změny pohlaví domáhala úřední změny svého pohlaví bez podstoupení sterilizace, jak stanoví § 21 odst. 1 zákona č. 373/2011 Sb., o specifických zdravotních službách a § 29 odst. 1 zákona č. 89/2012 Sb., občanský zákoník. Celý případ dospěl až k Ústavnímu soudu ČR s tím, že se paní T. H. domáhala zrušení současného znění výše uvedených právních předpisů, a to s odkazem na rozsudek páté sekce ESLP ze dne 6. 4. 2017 ve věci A. P., Garcon a Nicot v. Francie. Nicméně soudci Ústavního soudu ČR rozhodli kvalifikovanou menšinou v její neprospěch. Je však důležité podotknout, že článek nerozebírá pouze otázku sterilizace jakožto podmínky pro změnu pohlaví, ale dotýká se i dalších témat související s problémy transsexuálů, které české soudy řešily, a které nejsou dodnes řádně vyřešeny ani českými právními předpisy. |
Abstract in different language: | The institute of gender reassignment is not a common theme in Czech jurisprudence. One of the reasons may be the fact that, unlike homosexuality, this institute has only been known to the Czech legal system since the 1990s. However, even so, very interesting cases were dealt with by the Czech courts regarding gender reassignment issues. The most significant is the case of Mrs. T.H. She, regards the current legal regulation of the gender reassignment institute, demanded an official reassignment of her gender without undergoing sterilization, as stipulates in § 21 paragraph 1 of Act No. 373/2011 Coll., about specific health services and § 29 paragraph 1 of Act No. 89/2012 Coll., Civil Code. This case came to the Constitutional Court of the Czech Republic, with Mrs. T.H. demanding the annulment of the current wording of the above-mentioned legal regulations, referring to the judgment of the fifth section of the ECtHR of 06/04/2017 in the case of A. P., Garcon and Nicot v. France. However, the judges of the Constitutional Court of the Czech Republic ruled against her by a qualified minority. However, it is important to note that the article does not discuss only the issue of sterilization as a condition for gender reassignment, but also refers to other topics related to the problems of transsexuals that have been dealt with by the Czech courts, and which are still not properly resolved even by Czech legislation. |
