| Abstract: | Příspěvek pojednává o povinnostech člena statutárního orgánu obchodní korporace v případě, že tento člen přispěl porušením svých povinností k úpadku takové korporace. Rozbor bude věnován předchozí úpravě v porovnání s úpravou stávající. Dále bude věnován prostor předpokladům uložení takových zvláštních povinností, opomenuta nebude ani povaha soudního řízení o uložení těchto zvláštních povinností. |
| Abstract in different language: | The contribution deals with the duties of a member of a commercial corporation's statutory body where that member has contributed by breaching his duties to the bankruptcy of such a corporation. The analysis will be devoted to the previous adjustment compared to the adjustment become. Furthermore, space will be given to the preconditions for imposing such special obligations, nor will the nature of court proceedings for the imposition of such special obligations be disregarded. |
