| Abstract: | Diplomová práce se zabývá problematikou zásahu do integritu nezletilého a dotýká se většiny institutů s tím souvisejících. Úvodní kapitoly se zabývají obecnými pojmy jakožto osobností, osobnostních práv, a s tím související nedotknutelností osoby. Dále autorka představí právní předpisy, které zakotvují právní úpravu dotýkající se tělesné a duševní integrity, a také je v práci krátce rozebrána rodičovská odpovědnost určující práva a povinnosti mezi rodiči a dětmi. Hlavní podstata práce spočívá v úpravě, jak je možné zasáhnout do integrity nezletilého, a to na základě souhlasu, přivolení soudu a tzv. zákonné licence. Práce je zakončena konkrétními případy zásahů do integrity nezletilého. Konkrétně autorka vybrala pro svou práci tři instituty, a to umělé přerušení těhotenství, sterilizaci a očkování. |
| Abstract in different language: | The thesis deals with the issue of interference with the integrity of a minor and touches upon most of the related institutes. The introductory chapters deal with general concepts such as personality, personal rights, and the related inviolability of the person. Furthermore, the author introduces the legal provisions that enshrine the legislation touching on physical and mental integrity, and parental responsibility determining the rights and obligations between parents and children is also briefly discussed. The main thrust of the thesis is to regulate how the integrity of a minor can be interfered with, based on consent, court permission and the so-called statutory licence. The thesis concludes with specific cases of interference with the integrity of a minor. In particular, the author has chosen three institutes for her work, namely artificial interruption of pregnancy, sterilization and vaccination. |
