| Abstract: | Tato diplomová práce se zabývá právy a povinnostmi spoluvlastníků. Autor nejprve definuje pojem spoluvlastnictví podle římského práva. V následujících kapitolách byl vysvětlen pojem spoluvlastnictví a jeho druhy. Dále bylo nutné spoluvlastnický podíl definovat a popsat právo s ním nakládat. Tato kapitola zahrnuje rovněž předkupní právo. Práva spoluvlastníků byla následně rozdělena do čtyř hlavních podkapitol, kde byla podrobněji rozebírána. Následují dvě kapitoly týkající se vzniku a zániku spoluvlastnictví. Poslední velká kapitola se nazývá správa společné věci. Při psaní diplomové práce autor čerpal z mnoha odborných publikací - učebnic a odborných článků, zejména z komentářů k občanskému zákoníku. Tato práce vycházela i ze značného množství judikatury českých soudů. |
| Abstract in different language: | This diploma thesis concerns the rights and obligations of co-owners. The author first defines the concept of co-ownership according to Roman law. In the following chapters, the concept of co-ownership and types of co-ownership were explained. Then it was also necessary to dismantle the co-ownership share and the right to dispose of its share. This chapter also includes the right of pre-emption. The rights of co-owners were subsequently divided into four main subchapters, where they were discussed in more detail. The following are two chapters concerning the establishment and termination of co-ownership. The last major chapter is called the administration of the common cause. During the writing of the diploma thesis, the author drew on many professional publications - textbooks and professional articles, especially on the commentary on the Civil Code. This work was also based on a considerable amount of case law of the Czech courts. |
