| Abstract: | Tato diplomová práce se zabývá právními a kriminalistickými aspekty trestného činu znásilnění. Hlavním cílem diplomové práce je poukázat na závažnost dané problematiky. Práce je členěna na dvě partie (právní a kriminalistické aspekty), obsahuje rovněž úvod, závěr a cizojazyčné resumé. První část práce (právní aspekty) se zabývá historickým vývojem právní úpravy trestného činu znásilnění, poté následují kapitoly zabývající se současnou právní úpravou tohoto trestného činu. Předposlední kapitola se zaměřuje na komparaci trestného činu znásilnění a vybraných sexuálních deliktů, přičemž závěr této trestněprávní části je završen náměty de lege ferenda. Druhá část pojednávající o kriminalistických aspektech se věnuje metodice vyšetřování tohoto trestného činu. Pozornost je věnována především podnětům k vyšetřování, předmětu vyšetřování, typickým vyšetřovacím situacím, typickým stopám, počátečním vyšetřovacím úkonům, kriminalistickým verzím a následným vyšetřovacím úkonům. |
| Abstract in different language: | This diploma thesis deals with the legal and criminal aspects of the crime of rape. The main aim of the thesis is to point out the seriousness of the issue. The thesis is divided into two parts (legal and criminal aspects), it also contains an introduction, conclusion and a foreign language summary. The first part of the thesis (legal aspects) deals with the historical development of the legal regulation of the crime of rape, followed by chapters dealing with the current legal regulation of this crime. The penultimate chapter focuses on the comparison of the crime of rape and selected sexual offences, while the conclusion of this criminal part is completed with de lege ferenda themes. The second part, dealing with criminal aspects, focuses on the specifics of the investigation of this crime. Attention is paid primarily to incentives for investigation, the subject of the investigation, typical traces, typical investigative situations, initial investigative acts, investigative versions and the conclusion of this criminally oriented part is completed by subsequent investigative acts. |
