| Abstract: | Tato bakalářská práce se zabývá právní úpravou ochrany přírody NP Šumava. Práce je zpracována s cílem popsat, analyzovat a zhodnotit platnou právní úpravu ochrany přírody na území NP Šumava. Základním právním předpisem pro ochranu přírody a krajiny na území NP Šumava, který je v rámci této bakalářské práce využíván, je ZOPK. Celá bakalářská práce je rozdělena do sedmi kapitol. První kapitola je věnována samotnému vymezení základních pojmů týkajících se předmětu úpravy NP Šumava. Druhá kapitola se zabývá historickým vývojem územní a druhové ochrany na území NP Šumava. Ve třetí kapitole jsou představeny základní právní prameny, které upravují ochranu přírody a krajiny na území NP Šumava. Třetí kapitola týkající se pramenů právní úpravy NP Šumava je rozdělena na část mezinárodních právních pramenů, právních pramenů Evropské unie a vnitrostátních právních pramenů. Čtvrtá kapitola se věnuje zvláštním územním nástrojům ochrany NP Šumava, tedy zonaci, ochrannému pásmu a klidovým územím NP Šumava. Pátá kapitola se zabývá institucionálním zabezpečením ochrany přírody NP Šumava. Šestá kapitola je zaměřena na prostředky ochrany v NP Šumava, na základní a bližší ochranné podmínky a výjimky z jednotlivých zákazů a omezení. Sedmá kapitola se zabývá přeshraniční spoluprací NP Šumava a NP Bavorský les. V závěru celé bakalářské práce jsou shrnuty jednotlivé poznatky a úvahy, které by měly vést ke zlepšení nejen právní úpravy ochrany přírody NP Šumava. |
| Abstract in different language: | This bachelor thesis studies the legal regulation of nature protection in Šumava National Park. The aim of the thesis is to describe, analyse and evaluate the existing legal regulation of nature protection in the territory of the Šumava National Park. The basic legal regulation concernimg nature and landscape protection in the territory of the Šumava National Park, which is used in this bachelor thesis, is Act No. 114/1992 Sb., on Nature and Landscape Protection. The bachelor thesis is divided into seven chapters. The first chapter introduces a definition of the basic concepts related to the subject of the Šumava National Park. The second chapter deals with the historical development of territorial and species protection in the territory of Šumava National Park. The third chapter presents the basic legal sources that regulate nature and landscape protection in the territory of the Šumava National Park. The third chapter on the sources of legal regulation of the Šumava National Park is divided into sections specifying international legal sources, European Union legal sources and national legal sources. The fourth chapter characterizesspecific territorial instruments used for the protection of Šumava National Park, i.e. zoning, protection zone and quiet areas of Šumava National Park. The fifth chapter analyzes the institutional arrangements for nature protection in Šumava National Park. The sixth chapter introduces the instruments of nature protection of the Šumava National Park, as well as the basic and more detailed protection conditions and exceptions to individual prohibitions and restrictions. The seventh chapter discusses the cross-border cooperation between the Šumava National Park and the Bavarian Forest National Park, which are situated in the territory of Šumava. The whole bachelor thesis is concluded with a summary of individual findings and considerations, which should contribute not only to the improvement of the legal regulation of nature protection in the Šumava National Park. |
