| Abstract: | Úprava soukromých práv a povinností v občanském zákoníku je (stejně jako celý systém soukromého práva) založena na rozlišování mezi absolutními a relativními subjektivními právy. Teorie tohoto rozlišování je přitom v naší současné právní nauce zpracována toliko zkratkovitě. Zejména se opomíjí, že rozdíl mezi absolutními a relativními subjektivními právy je především kvalitativní. Nespočívá primárně v tom, vůči komu působí (erga omnes – inter partes), nýbrž v jejich odlišné podstatě. Článek je snahou o ucelené zpracování dosavadních teoretických poznatků. |
| Abstract in different language: | The regulation of private rights and obligations in the czech civil code is (like the entire system of private law) based on the distinction between absolute and relative subjective rights. The theory of this distinction is only briefly elaborated in our current legal doctrine. In particular, it is not recognised that the distinction between absolute and relative subjective rights is primarily qualitative. It lies not primarily in how the persons against whom these rights function are determined (erga omnes - inter partes), but in their different substance. The article is an effort to provide a comprehensive elaboration of the existing theoretical knowledge. |
