| Abstract: | V oblasti insolvenčního práva se v současné době zásadně řeší novely. Žádné jiné téma nebylo doposud předmětem tak četných a výrazných změn jako právě institut úpadkového práva. Po zásadních novelách bylo vždy možné hovořit o nové, zásadně proměněné podobě tohoto sankčního způsobu řešení úpadku. V tomto článku se proto zaměřuji na vývoj tohoto institutu v souvislosti s otázkou, kam a také odkud kráčí institut oddlužení a jakou povahu má jeho vývoj od přijetí moderní insolvenční české úpravy. |
| Abstract in different language: | In the field of insolvency law is being fundamentally discussed the amendments. No other topic has so far been the subject of so many and significant changes as the bankruptcy law institute. After the fundamental novels, it was always possible to call for a new, fundamentally changed form of this sanctioning method of dealing with bankruptcy. In this article, I focus on the development of this institute in connection with the question of where and from where the debt relief institute is going and what is the nature of its development since the adoption of the modern Czech insolvency regulation. |
