| Abstract: | Článek pojednává o právní úpravě práva stavby v české republice, do jejíhož právního řádu se tato úprava vrátila po více jako polovině století. Článek identifikuje mezery v positivní právní úpravě a diskutuje nad jejich předpokládaným výkladovým vývojem. Der Artikel befasst sich mit der rechtlichen Regelung des Erbbaurechts in der Tschechischen Republik, in deren Rechtssystem diese Problematik nach mehr als einem halben Jahrhundert zurückgekehrt ist. Der Artikel identifiziert Lücken in der positiven rechtlichen Regelung und diskutiert deren erwartete Auslegungsentwicklung. |
| Abstract in different language: | The article deals with the legal regulation of ground leases in the Czech Republic, where this issue has returned to the legal system after more than half a century. The article identifies gaps in the positive legal regulation and discusses its expected development of interpretation. |
