| Abstract: | Článek se zabývá procesem uzavírání úvěrové smlouvy se spotřebitelem, konkrétně zkoumáním jeho úvěruschopnosti. Dává odpověď na otázku, jaké konkrétní příjmy a jaké konkrétní výdaje musí poskytovatel úvěru zkoumat a jak má získané podklady vyhodnotit. Dále článek řeší situaci, kdy poskytovatel úvěru úvěruschopnost spotřebitele nezkoumá dostatečně. Neplatnost úvěrových smluv má dopad na žalobou požadované nároky a jejich splatnost, a proto se ve svém závěru článek zabývá i vlivem nedostatečně zkoumané úvěruschopnosti na civilní řízení. |
| Abstract in different language: | The article deals with the process of concluding a credit agreement with a consumer, specifically the examination of his creditworthiness. It provides an answer to the question of what specific income and what specific expenses the credit provider must examine and how to evaluate the information obtained. The article also addresses the situation where the credit provider does not sufficiently investigate the consumer's creditworthiness. The invalidity of credit agreements has an impact on the claims sought in an action and their repayment, and the article concludes by addressing the impact of inadequate creditworthiness investigations on civil proceedings. |
