Abstract: | Předmětem této práce je snaha o zobrazení stavu právní úpravy ochrany soukromí pacienta v České republice a dopadu této právní úpravy do praxe. Cílem práce je zodpovězení otázky, zda je možné ochránit soukromí pacienta do takové míry, aby byla zabezpečena důsledná ochrana respektování jeho osobnosti, jakožto individuální integrity, která je nutnou podmínkou existence fyzické osobnosti, aniž by tím docházelo k negativnímu omezování poskytovaných zdravotních služeb. Vlivem judikatury Evropského soudu pro lidská práva a s touto souladným vývojem judikatury soudů v České republice, rozšiřující vnímání pojmu soukromí také na právo na udržování a zachování mezilidské vztahů, je dílčím předmětem práce také zobrazení daného stavu z hlediska právní úpravy a zejména pak z hlediska praktického tj. konkrétních soudních rozhodnutích, čímž jsou orientačně mapovány okruhy možných negativních zásahů do osobnostních práv z daného hlediska. |
Abstract in different language: | The object of this research paper is the effort to illustrate the state of legal regulation concerning privacy protection of a patient in the Czech Republic and the consequences such legal regulation has on legal practice. The aim of this research paper is to answer the research question whether it is possible to protect the privacy of a patient to such extent, to ensure thorough protection of the respect towards his/ her personality as well as individual integrity. Such protection is the necessary precondition of the existence of a natural personality without negatively restricting the provision of medical services. Due to the influence of the European Court on Human Rights, the case law of the courts in the Czech Republic which is in compliance with the case law of the European Court on Human Rights and the extended perception of the term privacy on the right to keep and maintain interpersonal relationships, there is a marginal object of this research paper included. This marginal object presents illustration of the given state in the perspective of legal regulation and especially in a practical perspective; meaning the specific case law which allows to map the possible negative invasions into personal rights from the given point of view. |
