| Abstract: | Tato diplomová práce se zabývá problematikou porušení důležité povinnosti u trestných činů v silniční dopravě. Je to téma velmi zajímavé a aktuální, neboť v silničním provozu se pohybujeme téměř denně, nicméně také velmi složité. Odborná literatura se ale tomuto tématu bohužel příliš nevěnuje. V jednotlivých kapitolách jsou nejprve vymezeny a interpretovány základní pojmy, uveden přehled a charakteristika trestných činů v silniční dopravě, popsán princip omezené důvěry v dopravě, obecně vymezen pojem porušení důležité povinnosti a uveden přehled typických případů považovaných judikaturou za porušení důležité povinnosti v silniční dopravě. Stěžejní část práce je věnována problematice týkající se konkurence porušení důležité povinnosti oběma účastníky dopravní nehody, a sice konkurence porušení povinnosti dát přednost v jízdě a povinnosti dodržet povolenou, resp. přiměřenou rychlost. Byl vytvořen přehled nejzajímavějších soudních rozhodnutí, která řeší konkurenci porušení těchto dvou povinností. Rozhodnutí jsou seřazena chronologicky tak, aby byl vidět postupný vývoj a rozdíly. Dále je pojednáno o možnosti využití odklonů od trestního řízení v souvislosti s trestnými činy v silniční dopravě. Na závěr práce jsou z poznatků získaných studiem dané problematiky vyvozeny závěry a navržena doporučení, která by mohla přispět ke zlepšení současného stavu. |
| Abstract in different language: | This thesis deals with the breach of an important obligation of the road traffic criminal offences. This topic is very interesting and actual because each of us moves in road traffic almost every day, but also very complicated. But unfortunately, specialized literature doesn't attend to this topic very much. In the first chapter there are mentioned essential terms that are used at work. At first these terms are theoretically defined according to particular provisions of the Road Traffic Act, and then follow their explanation and interpretation. In the next chapters there is a brief characteristics and essential overview of the road traffic criminal offences and then the principle of limited trust in transport as a main principle that blends the whole chosen topic. The next part is devoted to a general definition of the breach of an important obligation in traffic. Because of the fact that this term is not defined anywhere in the act, for its definition they are used mainly the judicial decisions, which we can find large amount. Then there is mentioned the overview of typical cases that could be considered to be the breach of an important obligation according to practice of the courts. The main part of the work is devoted to the question relating to the competition of the breach of an important obligation by the both participants of traffic accident, namely competition of the breach of the obligation to give way and the obligation to keep the speed limit or adequate speed. Then there was created an overview of the most interesting judicial decisions that solve the competition of the breach of these obligations. The decisions are ordered chronologically, so that it is possible to see the gradual development and differences. The further chapter treats of the possibility of using diversions from criminal proceedings in connection with the road traffic criminal offences. At the end of the thesis there are drawn conclusions from the gained information and proposed recommendations that could contribute to an improvement of the current situation. |
