| Abstract: | Tématem práce je omezení svéprávnosti. V počátečních kapitolách jsou přiblíženy základní pojmy, které s omezením svéprávnosti souvisejí a historie tohoto právního institutu. Převážná část práce je věnována právní úpravě omezení svéprávnosti obsažené v občanském zákoníku - důvodech, které vedou k omezení svéprávnosti, a následcích omezení svéprávnosti. Opomenuta však nemohla zůstat ani procesní úprava omezení svéprávnosti, průběh řízení o omezení svéprávnosti, jeho zahájení, povinnosti soudu a vynesení rozsudku. |
| Abstract in different language: | The topic of this diploma work is the restriction on legal capacity. The initial chapters focus on basic terminology related to the topic as well as the history of this legal concept. Major part of the work deals with law regulation of the restriction on legal capacity included in the Civil code, the reasons which lead to the restriction on legal capacity and its consequences. It is further concerned with procedural law regulation of the restriction on legal capacity, the conduct of the restrictions on legal capacity, starting with launching the inquiry, the obligation of the court and finishing with pronouncement of the verdict. |
