| Abstract: | Cílem práce by měla být odpověď na otázku, co jsou to obstrukce a zda se tyto nechají v přestupkovém řízení eliminovat, popř. jak. Čtenář by měl být po přečtení práce blíže seznámen s problematikou a na základě získaných poznatků by měl být schopen obstrukční praktiky rozpoznat. Práce by teoreticky mohla být přínosem pro správní orgány rozhodující o přestupcích v I. stupni, neboť těch se problematika dotýká nejvíce a zároveň zahlcenost těchto orgánů často reálně neumožňuje, aby oprávněné úřední osoby mohly být vždy seznámeny s nejnovějším vývojem judikatury. Diplomová práce je rozdělena na dvě části. V první části se pokusím zejména přiblížit a vysvětlit základní pojmy definujících danou problematiku, a to zneužití práva, prekluzivní lhůtu, obstrukce aj. Ve druhé části práce se poté budu věnovat popisu některých možných druhů obstrukčního jednání a uvedu k nim i konkrétní příklady z praxe. Dále se v práci pokusím popsat nejčastější obstrukční praktiky. Při zpracování práce je vycházeno zejména z judikatury a její přínos vyplývá právě z uvedení konkrétních případů z praxe. |
| Abstract in different language: | The diploma thesis is focused on obstruction in the process of traffic offenses. The benefit of this work is above all the grouping of diverse opinions on the given issue and the presentation of examples of possible solutions to the emergence of undesirable situations in the administrative proceedings.The diploma thesis is divided into two parts. In the first part I will try to explain and explain the basic concepts that are fundamental to the given issue, namely abuse of law, preclusive time, obstruction, etc. In the second part of the paper I will then describe some possible types of obstructional behavior and will include specific examples from practice. Further, I will try to describe the most common obstructive practices. The aim of the thesis should be to answer the question of what are the obstructions and whether they will be eliminated in the offense proceedings, as. The reader should be more familiar with the subject after reading the paper, and he should be able to recognize obstructive practices on the basis of the acquired knowledge. In theory, the work could be beneficial for administrative bodies deciding on misdemeanors in the first degree, because those issues are most concerned, and the overworking of these bodies often does not really allow authorized officials to always be acquainted with the latest developments in the case law. |
