| Abstract: | Diplomová práce je věnována tématu nedovolenou výrobu a jiné nakládání s omamnými a psychotropními látkami a s jedy ve znění §283 Trestního zákona. Hlavním cílem je vytvoření uceleného přehledu vývoje právního pojetí nedovolené výroby a jiného nakládání s těmito látkami. Obsahuje vymezení pojmů, definici omamné a psychotropní látky a jedu. Dále obsahuje historický vývoji drogové kriminality v rámci mezinárodního i evropského práva až do současné doby. Dále historický vývoj v trestním právu od vzniku Československé republiky. Navazuje popis a vysvětlení právní úpravu de lege lata a v poslední kapitole právní úprava de lege ferenda, kde jsou nastíněny návrhy řešení současných problému. |
| Abstract in different language: | The master's thesis is devoted to the topic of illicit production and other handling of narcotic and psychotropic substances and toxins in the wording of Section 283 of the Criminal Code. The main objective is to provide a comprehensive overview of developments in the legal concept of illicit manufacture and other handling of these substances. It contains explanations of terms, definition of narcotic and psychotropic substances and poison. It also contains the historical developments of drug crime in international and European law up to the present. Next chapter contain historical development in criminal law since the founding of the Czechoslovak Republic. It follows the description and explanation of the legal regulation de lege lata, and in the last chapter the de lege ferenda legislation, which outlines the solutions to the current problem. |
