| Abstract: | Článek rozebírá jedno rozhodnutí Vrchního soudu v Praze, který řešil otázku výslechu dítěte nízkého věku a požadavkům na řádné poučení takového svědka s ohledem na následnou použitelnost takto získaného důkazu. Dále se článek zabývá v souvislosti s uvedeným rozhodnutím pojmem pohlavního styku, a to pohlavního styku provedeného způsobem srovnatelným se souloží, který uvádí ustanovení § 185 odst. 2 písm. b) trestního zákoníku a který je jedním z alternativně uvedených znaků kvalifikované skutkové podstaty znásilnění. |
| Abstract in different language: | The article discusses one decision of the High Court in Prague, which dealt with the question of interrogation of a child of a low age and the requirements for proper instruction of such a witness with regard to the subsequent applicability of the evidence thus obtained. Furthermore, the article deals with the concept of sexual intercourse, in the context of that decision, namely sexual intercourse carried out in a manner comparable to cohabitation, which states the provisions of § 185 par. (b) of the Criminal Code and which is one of the alternatives to the qualified facts of the rape. |
