| Abstract: | Autor, sám soudce Metropolitního církevního soudu Arcidiecéze pražské, v článku upozorňuje na některá sporná či ne zcela transparentní místa v právní úpravě rozsudku církevního soudu (incipit, citování judikatury, povinné/doporučené údaje v pasážích in jure a in facto, odůvodnění výroku v konkluzi, formulace enunciátu ve věci samé, poučení o opravném prostředku apod.) Současně navrhuje jejich řešení alespoň na partikulární justiční rovině, tj. u církevních soudů v rámci území České biskupské konference. |
| Abstract in different language: | The author, judge of the Metropolitan Church Court of the Archdiocese of Prague, points out some controversial or not completely transparent points in the legal regulation of the ecclesial court judgment (incipit, citation of case law, mandatory/recommended data in passages in jure and in facto, reasoning of the statement in conclusion, formulation of enunciate on the merits, instruction of remedial measure, etc.) in the article. At the same time, he proposes a solution at least on a particular judicial level, i. e. concerning ecclesiastical courts within the territory of the Czech Bishops´ Conference |
