| Abstract: | Tato kvalifikační práce se zabývá problematikou vymáhání pohledávek věřiteli v rámci insolvenčního řízení. Stěžejní pozornost je v celé práci věnována vlivu judikatury na právní úpravu insolvenčního práva ve vztahu k pohledávkám a na samotný proces vymáhání pohledávek věřiteli. Jako příklad dílčího tématu zpracování lze uvést odlišnost pohledávek vykonatelných a nevykonatelných a s tím související účinky popěrných úkonů či problematiku titulů vykonatelnosti či stanovení úkonů insolvenčního soudu a účastníků řízení. |
| Abstract in different language: | This qualifying work deals with issues of debt recovery to the creditor in insolvency proceedings. The main focus is on the impact of the jurisprudence on the legal regulation of insolvency law in relation to receivables and on the actual process of recovery of debts to the creditor. An example of a sub-theme of the processing may be the difference between the claims of enforceable and unenforceable and the related effects of the acts of bribery or the issue of the titles of enforceability or the determination of the actions of the insolvency court and the parties to the proceedings. |
