| Abstract: | V diplomové práci se zabývám problematikou ohledání v trestním řízení. Jedná se o institut typický pro přípravné řízení. Úvodní části práce vymezuji základní pojmy trestního řízení, důkazního práva a dokazování v trestním právu. Poté se zaměřuji na vymezení pojmu ohledání. Dále v práci charakterizuji základní zásady, jež jsou důležité pro institut ohledávání. Kromě toho se zabývám jednotlivými druhy ohledávání, subjekty, oprávněné k provedení ohledávání, a také metody a postupy zvolené při ohledávání. Zaměřila jsem se na rozbor lidsko-právních pojmů osobní a domovní svoboda, které mají základ v ústavním právu a souvisí současně i s trestním právem. Poté jsem se zabývala otázkou, omezením zmíněních práv. V poslední části své práce jsem se zaměřila na ohledání a celkový rozpor v souvislosti s právem na osobní a domovní svobodu. Závěrem své práce jsem řešila otázku, zdali je právní úprava ohledání dostatečná a poskytuje nám ucelený přehled. |
| Abstract in different language: | In this diploma thesis I deal with the issue of investigation in criminal proceedings. It is the institute typical for preparatory management. In addition, I believe that it is necessary to understand the circumstances underlying the examination. That is why I decided in the introductory part of my work to define the basic concepts of criminal proceedings, proofing, criminal law. Then I focused on defining the concept of examination. I also describe the basic principles that are important for the investigation institute. I also focused on the types of examination, the subjects eligible to conduct the examination, and the methods and procedures chosen during the examination. In addition, I focused on the analysis of human-legal concepts of personal and household freedom, which are based on constitutional law and are related to criminal law at the same time. Then I dealt with the question, the limitations of the rights mentioned, and in the last part of my work I focused on the examination and the general contradiction in the context of the right to personal and residential freedom. In conclusion of my thesis, I addressed the question whether the legal regulation of the examination was sufficient. |
