| Abstract: | Diplomová práce se zabývá tématem dovolání. Práce je rozdělena do dvou pomyslných částí. První část se zabývá problematikou aktuální právní úpravy a vývojem institutu dovolání, který jí historicky předcházel. Ve druhé části se autor zabývá některými vybranými otázkami, jako je novela OSŘ č. 296/2017 Sb., vztah dovolání a ústavní stížností nebo úvahami, nad některými otázkami de lege ferenda - i ve vztahu k věcnému záměru civilního řádu soudního, resp. k (ne)potřebě nového zákoníku, který bude upravovat civilní proces. |
| Abstract in different language: | This graduate thesis deals with the topic "extraordinary appeal" (or appellate review). The thesis is divided into two sections. The first section describes the development of the institute of appellate review in historical context and its contemporary form influenced by its development. In the second section the question is discussed whether or not the current state and form of appellate review is desirable. The author of this thesis reflects de lege ferenda; apart from the characteristics of the subject-matter of the Civil Procedure Code, he also addresses the question if it is desirable to continue with amendments to the current legal regulation or if a recodification of the Czech Civil Procedure should be made. |
