| dc.description.abstract | Diplomová práce se zabývá v první části samotným promlčením, když vymezuje jeho pojem, podstatu a účel úpravy v občanském zákoníku. Podává rovněž výklad o historických souvislostech, předmětu promlčení a promlčecí lhůtě. V druhé části je popsána námitka promlčení jako obrana dlužníka proti promlčenému právu, které je věřitelem uplatňováno před soudem. Práce podává komparaci názorů na spornou povahu námitky promlčení, poukazuje na to, jaký subjekt může promlčení namítnout a vůči komu tak činí. V závěru autorka nahlíží na specifické pojetí promlčení v anglickém právu. | cs |
