| Abstract: | Práce se zabývá tématem likvidace pozůstalosti, tedy procesem, který může nastat v případě, kdy dluhy zůstavitele převyšují hodnotu jeho majetku. Cílem práce je komplexně nastínit celý proces, a to od fáze předcházející nařízení likvidace až po postup navazující na vydání rozvrhového usnesení. Práce se také zabývá nejasně vymezenými fázemi řízení a pomocí úvah de lege ferenda navrhuje možnosti pro vyjasnění celého procesu, s čímž souvisí i zjednodušení činnosti soudního komisaře. V závěru se práce zaměřuje na komparaci s předchozí právní úpravou. |
| Abstract in different language: | The thesis deals with the topic of liquidation of the estate, which is a process that may occur when the debts of the testator exceed the value of his estate. The aim of the thesis is to outline the whole process of liquidation of the estate. The work also deals with the unclearly defined phases of the proceedings and, by means of de lege ferenda considerations, proposes possibilities for clarifying the whole process, which is related to simplifying the activities of the notary. Finally, the thesis focuses on a comparison with the previous legislation. |
