| Abstract: | Tato diplomová práce pojednává o problematice domácího násilí z pohledu trestního práva. Klade si za cíl popsat aspekty domácího násilí a vybrané z nich následně aplikovat do dotazníkového šetření a tímto zkoumat pohled a zkušenosti respondentů s domácím násilím. Autorka se nejprve zabývá pojmem domácího násilí, jeho historickým vývojem a identifikací. Podstatnou část práce tvoří pojednání o trestných činech dle ustanovení § 199 a 198 zákona č. 40/2009 Sb., trestního zákoníku, a zmíněna jsou i vybraná specifika trestního řízení se zaměřením na práva obětí a dokazování. Při porovnávání zejména trestněprávních úprav vybraných zemí (České a Slovenské republiky, Španělského království) se autorka práce vyjadřuje k aktuálním tématům, např. k návrhu definice domácího násilí, problematice femicid či zavedení specializace soudců. |
| Abstract in different language: | This thesis deals with the issue of domestic violence from the perspective of criminal law. It aims to describe the aspects of domestic violence and then apply selected aspects of domestic violence to a questionnaire survey to explore respondent´s views and experiences of domestic violence. The author first addresses the concept of domestic violence, its historical development and identification. A substantial part of the thesis consists of a discussion of offences under the provisions of Sections 199 and 198 of Act No. 40/2009 Coll., the Criminal Code, and selected specifics of criminal proceedings are also mentioned, with a focus on victim's rights and evidence. While comparing the criminal legislation of selected countries (the Czech and Slovak Republics, the Kingdom of Spain), the author of the thesis comments on current topics, such as the proposed definition of domestic violence, the problem of femicide or the introduction of the specialization of judges. |
