| Abstract: | Diplomová práce se zabývá institutem bezdůvodného obohacení tak jak je tento obsažen a zařazen v právním řádu České republiky. Pozornost je zaměřena na historický vývoj tohoto institutu, právní vztah, který z tohoto institutu vzniká a dále pak na rozbor jeho jednotlivých skutkových podstat. V neposlední řadě se práce věnuje srovnání platné právní úpravy tohoto institutu s úpravou v novém občanském zákoníku a s úpravou v právním řádu Spolkové republiky Německo. |
| Abstract in different language: | The thesis deals with the Institute of unjust enrichment as it is covered and enshrined in the legislation of the Czech Republic. Attention is focused on the historical development of this institution, the legal relationship which arises from this institute and then analysis of the individual merits. Finally the thesis is focused on comparison of the valid legislation of this Institute with the provision in the new Civil Code and the adaptions in the legal system of the Federal Republic of Germany. |
