| Abstract: | Tato práce je zaměřena na vykázání osoby ze společného obydlí jako oprávnění Policie České republiky. Záměrně je proveden exkurz do problematiky domácího násilí, neboť toto téma je s vykázáním úzce spjato. Práce podrobně rozebírá institut vykázání v původním i současném zákoně o policii, uvádí důvody, které vedly zákonodárce k jeho zavedení do českého právního řádu i právní prostředky obrany proti vykázání. Samostatná kapitola je věnována právním aspektům vykázání podle dalších právních předpisů. Práce také seznamuje čtenáře s právními úpravou vykázání v Rakousku a na Slovensku. Poslední kapitola nabízí možná řešení problematiky institutu vykázání de lege ferenda. |
| Abstract in different language: | This work focuses on the Expulsion as a competency of the Police of the Czech Republic. The thesis intentionally makes an excursion to the issue of domestic violence as a topic closely linked with the Institute of Expulsion. The work details the Institute of Expulsion in the original and current legislation of Police Act. It also states the reasons which led the legislature to its introduction into the Czech legal order and legal means of defense against the Expulsion. A separate chapter is devoted to the legal aspects of the Expulsion under other legislation. This work also introduces readers to the legislation of the Expulsion in Austria and the Slovak Republic. The last chapter provides possible solutions to the issue of the Institute de lege ferenda. |
