| Abstract: | Předložená práce pojednává o dvou významných institutech soukromého práva, dobrých mravech a poctivém obchodním styku. Snaží se přiblížit vzájemný vztah obou institutů a jejich aplikovatelnost na obchodněprávní vztahy. S ohledem na relativně krátkou platnost nové právní úpravy si práce klade za cíl zejména vymezení institutů v ustálené judikatuře, ze které soudní praxe bude muset vycházet i při aplikaci nové úpravy. |
| Abstract in different language: | The presented thesis deals with two significant institutes of private law, good manners and fair business transaction. It tries to approach the interrelation of both institutes and their applicability on the relationships of business law. Regarding to relatively short validity of the new legislation, primarily the thesis aims to define the institutes in the terms of stable jurisprudence, which will form the basis for the judicial practice even after the new legislation will have been applied. |
