| Abstract: | Práce se zabývá rozdílem mezi součástí věci (pars rei) a jejím příslušenstvím (pertinentia) v římském právu a v právu současném, včetně otázky právního postavení užitků a plodů věci od okamžiku jejich oddělení. Pozornost je věnována projevům a aplikaci zásady superficies solo cedit. Součástí práce je také posouzení zpracování problematiky součásti a příslušenství věci v Novém Občanském Zákoníku z perspektivy tradice římského práva. |
| Abstract in different language: | The study deals with the difference between the part of a thing (pars rei) and its accessories (pertinentia) in Roman and modern law, including the question of the legal status of benefits and fruit of things from the moment of their separation. The attention is devoted to manifestations and application of the principle of superficies solo cedit. The study also includes assessment of processing problems of parts of thing and accessories in the new Civil Code from the perspective of the tradition of Roman law. |
