| Abstract: | V důsledku nárůstu úpadků v posledních letech dochází často k insolvenčním řízením, jimiž jsou často zasažena společná jmění manželů. Úpadek pak má různý vliv na SJM v závislosti na konkrétním způsobu řešení úpadku. Práce podrobně rozebírá jednotlivé způsoby řešení úpadku a jejich vliv na společné jmění manželů, společné oddlužení manželů, a také se zabývá historickým vývojem manželského majetkového práva v souvislosti s insolvenčním řízením. |
| Abstract in different language: | As a result of the increased number of bankruptcies in the recent years the insolvency proceedings which affect the community property of a married couple have become more common. A bankruptcy has different influence on the community property depending on the means used to solve the bankruptcy. This thesis describes in depth the individual means of solving the bankruptcy and its influence on the community property of a married couple, the community debt relief of a married couple and is also concerned with the historical development of the community property of a married couple in the context of insolvency proceedings. |
