| Abstract: | Cílem diplomové práce je nalezení hranic samostatné působnosti obcí v judikatuře Ústavního soudu. Tento problém je úzce svázán s právem na územní samosprávu. Jedná se o důležitou otázku pro každého občana, neboť normotvorba obcí může zasáhnout jeho každodenní život. Práce má dvě části - v zásadě teoretickou a praktickou. Teoretická část předkládané práce prezentuje toto téma a odborné pojmy (např. právo na územní samosprávu, obec, samostatná působnost obcí, Ústavní soud) za použití právních předpisů a odborné literatury. Druhá část této práce sleduje a hodnotí vývoj judikatury Ústavního soudu. Jednotlivé judikáty jsou analyzovány. Následně jsou sledovány a zjišťovány obecné závěry. Na konci práce jsou vyhodnoceny meze samostatné působnosti obcí. |
| Abstract in different language: | The goal of this thesis is the finding of the limitations of municipal self-government in case law of the Constitutional court. This issue is closely connected with the right to local self-government. It is important question for every citizen, because legislation of municipalities it can affect daily life. This work has two parts essentially theoretical and practical. The theoretical part of this thesis presents this topic and technical terms (for example the right to local self-government, municipality, municipal self-government, Constitutional court) using laws and specialist literature. The second part of this work follows and judges development of case law of the Constitutional court. Individual court decision are analysed. Then changes are monitored and detected general conclusions. At the end of the work are evaluated limits of the limitations of municipal self-government. |
