| Abstract: | Vyvlastnění jako nucené omezení či odebrání vlastnických práv je nejzazším zásahem do vlastnických práv, na jehož základě lze vlastnická práva omezit či úplně odebrat. Musí proto splňovat celou řadu náležitostí, upravených na úrovni ústavní, mezinárodní, zákonné i podzákonné. Naše právní úprava institutu vyvlastnění je značně roztříštěna do mnoha předpisů, čemuž tak bylo i v minulosti. Speciální úpravou je zákon č. 184/2006 Sb. O vyvlastnění, který upravuje podmínky vyvlastnění, vyvlastňovací řízení, jeho subjekty, náhradu za vyvlastnění a upravuje také soudní řízení. |
| Abstract in different language: | The expropriation is an act of the government in taking private property for the needs of public use and it is an institute of administrative law. Nowadays the legislation provides quite complex protection to the private owners thanks to a constitutional principles, commonly accepted international agreements and regulations. The process of expropriation includes the obligation holding to secundum et intra legem rule, validation of the property, the assessment of public use and benefits, which must be above the private owners´ right. The most frequently reasons for the expropriation are the construction of highways, airports, public utilities and infrastructure in general. |
