| Abstract: | Zákon o státní službě č. 234/2014 Sb. je právní úpravou relativně novou a zároveň je stěžejním předpisem pro oblast státní služby. Tato práce si klade za cíl analyzovat zákon o státní službě a současně zachytit důsledky aplikace tohoto zákona v praxi. Pozornost je věnována historickému kontextu vzniku zákona č. 234/2014 Sb. a okolnostem jeho přijetí, stejně tak ale i nejnovějšímu legislativnímu vývoji. Rovněž je obsaženo shrnutí cílů této právní úpravy a její popis s důrazem na problematiku služebního poměru státních zaměstnanců a dalších aspektů pojících se k výkonu státní služby. Diplomová práce se také zaměřuje na komparaci s ostatními právními předpisy upravujícími oblast státních zaměstnanců a poukazuje na těsnou vazbu se správním řízením. Praktické zkušenosti implementace zákona o státní službě jsou objasňovány v souvislosti s vybranými tématy a práce rovněž zahrnuje vyhodnocení statistických dat dostupných pro státní službu. Závěr práce hodnotí a formuluje nejdůležitější poznatky a snaží se o nalezení možných východisek v případech zjištěných nedostatků zákona o státní službě. |
| Abstract in different language: | The civil service act no. 234/2014 Sb. is relatively new but at the same time the most fundamental legal document in the field of the civil service. This thesis aims to conduct an analysis of this act and in doing so identify the consequences of its aplication in practice. Attention is given to historical context of the genesis of the act no. 234/2014 Sb. and the circumstances of its adoption and the latest legal developments are also included. The thesis summarises the aims of this act and its impact, especially on the employement of civil servants and other aspects of the civil service. Then it contains a comparison with other important laws which are connected with working for the state and its coherency with administration procedure. Practical experiences of the implementation of the civil service act are presented in connection with the chosen topics. Available statistical data from the field of the civil service are also evaluated. The conclusion of this thesis evaluates and formulizes the most important findings and tries to find possible solutions in cases of inadequacies of the civil service act. |
