| Abstract: | Diplomová práce se zabývá náboženským vyznáním, jeho svobodou v rámci práva evropských států, historií této svobody a jejím omezením, tedy mezí projevu náboženského vyznání. Jsou definovány stěžejní pojmy, vymezena právní úprava náboženské svobody v evropském rámci a charakterizován vztah ESLP a ESD. Dále je přiblížena činnost ESLP a formace, ve kterých rozhoduje. V návaznosti na to jsou vymezeny obecné podmínky zásahu do práva na projev náboženského vyznání. Hlavní část práce spočívá ve vyhledávání mezí projevů náboženského vyznání a faktorů, které jsou zhodnoceny při rozhodování v judikatuře ESLP v autorem do několika oblastí rozdělených případech. |
| Abstract in different language: | The diploma thesis deals with religion, its freedom within the law of European states, history of this freedom and its limitations, the limits manifestation of religion in European states. The key concepts are defined, the legal framework for religious freedom is defined in the European framework and the relationship between the ECHR and the ECJ is characterized. Furthermore, the work of the ECHR and the formation in which it decides are discussed. Consequently, the general conditions for interference with the right to religious expression are defined. The main part of the work is to find out the limits of the manifestations of religion and the factors that are evaluated in decision-making in the ECtHR case law divided by author into several areas |
