| Abstract: | Diplomová práce se zabývá místní příslušností soudních exekutorů. Práce je rozdělena do čtyř kapitol. Zprvu vymezuje postavení soudního exekutora a stručně přibližuje průběh exekučního řízení. Cílem diplomové práce je popis současné právní úpravy místní příslušnosti soudních exekutorů a analýza diskuze zastánců a odpůrců změny právní úpravy v této oblasti. Práce rovněž popisuje proběhlé legislativní pokusy o zavedení teritoriality soudních exekutorů v České republice a v neposlední řádě obsahuje úvahy de lege ferenda. Tyto úvahy představují teritoriální modely, které jsou v souvislosti se zavedením teritoriality v České republice často skloňovány. Dále popisuje právní úpravu místní příslušnosti soudních exekutorů na Slovensku a její dosavadní dopady. |
| Abstract in different language: | This master thesis deals with the territorial jurisdiction of court executors. The thesis is divided into four chapters. Initially, it defines the position of the court executor and briefly outlines the course of the execution proceedings. The goal of the thesis is to describe the current legal regulation of the territorial jurisdiction of court executors and analyze the discussion between supporters and opponents of a change in the legal regulation in this area. The thesis also describes the legislative attempts that have been made to introduce territoriality of court executors in the Czech Republic and includes considerations de lege ferenda. These considerations present territorial models that are often discussed in connection with the introduction of territoriality in the Czech Republic. Additionally, the thesis describes the legal regulation of the territorial jurisdiction of court executors in Slovakia and its current impact. |
