| Abstract: | Tato práce se zaměřuje na problematiku institutu dohody o vině a trestu. Práce obsahuje historickou část, v níž popisuji vývoj dohody o vině a trestu. Ve druhé části práce jsem se věnoval pečlivému rozboru institutu v rámci trestního řízení. Především jsem se věnoval procesu sjednání dohody v přípravném řízení a posléze procesu schválení či neschválení daného návrhu. V závěrečné části této práce jsem se rozhodl analyzovat dohodu ve světle trestněprávních zásad. Závěrečnou část zakončuje judikatura věnující se tématu dohodě o vině a trestu, která odpovídá na kontroverzní otázky. |
| Abstract in different language: | This thesis focuses on the issue of the institute of plea bargaining. The thesis contains a historical part in which I describe the development of the plea bargain. In the second part of the thesis, I carefully analyze the institute in the context of criminal proceedings. First of all, I have focused on the process of negotiating the agreement in pre-trial proceedings and then on the process of approving or disapproving the proposal. In the final part of this thesis I decided to analyse the agreement in the light of criminal law principles. The final part concludes with case law dealing with the topic of plea bargaining, which answers controversial questions. |
